In light of this Court's opinion dated November 7, 2019, this case is referred back to be reassigned to a new referee for a hearing and recommendation as to the appropriate discipline. The Honorable Bertila Ana Soto, Chief Judge of the Eleventh Judicial Circuit Court of Florida, is directed to appoint a new referee, within fourteen days of this order, and to notify the Clerk of the Florida Supreme Court and the parties as to the judge appointed as referee. The newly-assigned referee shall file a report within ninety days of his or her appointment.

|
|
FSC-OPINION: Therefore, we disapprove the referee's report and remand this case to a newly appointed referee for a hearing limited to a determination of recommended discipline. Finally, we also disapprove the referee's determination that the parties bear their own costs, and direct that the Bar submit its statement of costs, pursuant to Bar Rule 3-7.6(q)(5), following the additional proceedings before the newly appointed referee. It is so ordered.
