Click to open document 04/26/2019 ORDER-OTHER SUBSTANTIVE The Chairs of the Committee on Standard Jury Instructions in Civil Cases and the Committee on Standard Jury Instructions in Contract and Business Cases are hereby directed to file a supplemental report addressing question one on proposed model verdict form 451.14, which asks, "Did (defendant) owe a fiduciary duty to (claimant)?" The supplemental report should explain how question one relates to instructions 451.4 and 451.7a, and specifically, should explain whether question one unintentionally asks the jury to decide a question of law. See Gracey v. Eaker, 837 So. 2d 348, 354 n.7 (Fla. 2002) ("[T]he existence, vel non, of a duty is a question of law") (citing McCain v. Fla. Power Corp., 593 So. 2d 500, 503 (Fla. 1992) ("[D]uty exists as a matter of law and is not a factual question for the jury to decide: Duty is the standard of conduct given to the jury for gauging the defendant's factual conduct.")). The Committees should also specifically address whether question one should more closely track the factual question that the jury is instructed to decide in instruction 451.4 and ask whether a "relationship existed between (claimant) and (defendant) in which (claimant) put [his] [her] [its] trust in (defendant) to protect (claimant's) [financial or property interests] [secrets] [confidences] [private information] and (defendant) accepted that trust." The Chairs are allowed to and including May 29, 2019, in which to file the supplemental report.
