Click to open document 02/28/2019 ORDER-OTHER SUBSTANTIVE Upon review of the proposals of the Committee on Standard Jury Instructions in Criminal Cases (Committee) in the instant case, the Court is considering revising the definition of "great bodily harm" consistent with the entire definition as provided in Wheeler v. State, 203 So. 3d 1007 (Fla. 4th DCA 2016). The Court seeks the Committee's comment limited to the revisions indicated in underlined text in the attached appendix to this order. If the Committee agrees with this revision, the same will be made to instructions 7.9 (Vehicular or Vessel Homicide) and 16.12 (Leaving a Child Unattended or Unsupervised in a Motor Vehicle) from case number SC18-1692, and instructions 15.1 (Robbery), 15.2 (Carjacking), and 15.3 (Home-Invasion Robbery) from case number SC18-1295. The comments are to be filed on or before April 1, 2019.
