|
|
FSC-OPINION: We conclude that the proper standard of review on appeal when reviewing a trial court's determination, in a dissolution of marriage, of whether a spouse had donative intent to establish that property was an interspousal gift subject to equitable distribution is "competent, substantial evidence." In this case, we conclude that such evidence existed to support the trial judge's conclusion that both properties at issue were marital assets under section 61.075, Florida Statutes. Accordingly, we quash the Fourth District's ruling as to Hickstead and affirm as to Lake George, effectively reinstating the equitable distribution in the trial court's Amended Final Judgment.
It is so ordered.
