Upon consideration of the reports of referee and the briefs filed in these consolidated cases, the referees' findings of fact and recommendations of guilt are hereby approved. However, the recommended discipline, a three-year suspension, is disapproved, and respondent is disbarred effective thirty days from the date of this order so that respondent can close out his practice and protect the interests of existing clients. If respondent notifies this Court in writing that he is no longer practicing and does not need the thirty days to protect existing clients, this Court will enter an order making the disbarment effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(h). Further, respondent shall accept no new business from the date this order is filed. The respondent is further directed to provide payment to Dr. Hoehn in the amount of $2,000.00, under the terms and conditions set forth in the report. Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Christopher M. Chestnut in the amount of $28,049.43, for which sum let execution issue. Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this disbarment.

Respondent has filed a "Motion for Rehearing of the Order to Disbar Christopher Chestnut," and the Bar has filed a response to the motion.
In his motion, Respondent asserts that the Court denied his due process rights by increasing the sanction in this case without first issuing an order to show cause. The Court typically issues an order to show cause in cases where the respondent has not had the opportunity to address the length or type of sanction being considered by the Court. The Bar challenged the referee's recommendation in Case Nos. SC16-797 and SC17-307, contending that Respondent's conduct in both cases warranted disbarment. Respondent was thus aware disbarment was being considered by the Court and had ample opportunity to explain why disbarment was not appropriate in his answer briefs. He did not, however, file an answer brief in Case No. SC17-307 and he did not address the Bar's arguments on discipline in his answer brief in Case No. SC16-797. As a result, Respondent waived his opportunity to make any arguments that could have been made in response to an order to show cause. Respondent's other arguments on rehearing present issues that were already raised and addressed in the briefing of this case, and that were fully considered by the Court. Accordingly, Respondent's motion is hereby denied.
