ORDER-RECORD (RETURNED FOR CORRECTION)
|
|
Appellee's Motion to Correct the Record on Appeal (copy attached) is granted. The court reporters are directed, on or before April 15, 2019, to file with the trial court clerk a corrected transcript of trial that is consecutively numbered as required by Rule 9.200(b)(4). The transcript of trial shall be in chronological order of court event, shall include a master trial index containing the names of the witnesses, list of exhibits and corresponding pages, and shall be paginated to exactly match the pagination of the master trial index as required by Rule 9.200(d)(2)(B). Pursuant to Rule 9.200(d)(1)(A), the transcript of the trial shall be kept separate from the remainder of the record on appeal and shall not be renumbered by the clerk.
Counsel for appellant is directed to deliver a copy of this order to all court reporters involved in the transcription and to provide the necessary direction to ensure that the transcript is filed within the time period designated.
The trial court clerk is directed, on or before May 6, 2019, to file an unredacted trial transcript as well as a corrected and unredacted record. Pursuant to Rule 9.200(d)(1)(C), the entire record, except for the above-referenced trial transcript, shall be compiled into a single PDF file and paginated so that the page numbers displayed by the PDF reader exactly match the pagination of the index. Copies of the corrected record and transcript and any exhibits shall be transmitted to the appeals division of the Office of the Public Defender for the Second Judicial Circuit and Office of the Attorney General.
Appellant's Motion to Strike the "Designation of Appellate Counsel" Portion of Appellee's Motion is denied. Appellant shall have 77 days from the filing of the corrected record in this Court in which to file the initial brief on the merits.
