Upon consideration of the uncontested report of the referee, the parties' conditional guilty plea for consent judgment, and the motion to assess costs, it is the judgment of this Court that the Report of Referee Accepting Consent Judgment and the Conditional Guilty Plea for Consent Judgment, filed with this Court on December 14, 2020, are hereby disapproved. Accordingly, the Court hereby refers this case back to the referee for further proceedings in accordance with the Rules Regulating the Florida Bar. The uncontested amended report of the referee is approved and respondent is suspended from the practice of law for three years. Respondent was placed on the inactive list; therefore this suspension is effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(h). Respondent shall also fully comply with Rule Regulating the Florida Bar 3-6.1, if applicable.
Respondent is further directed to comply with all other terms and conditions of the amended report and amended consent judgment. Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from John Gillespie in the amount of $4,936.76, for which sum let execution issue.
