Accordingly, for the reasons stated in this opinion, we reverse the final judgment of the trial court dated December 4, 2000, and remand this cause for the circuit court to immediately tabulate by hand the approximate 9,000 Miami-Dade ballots, which the counting machine registered as non-votes, but which have never been manually reviewed, and for other relief that may thereafter appear appropriate. The circuit court is directed to enter such orders as are necessary to add any legal votes to the total statewide certifications and to enter any orders necessary to ensure the inclusion of the additional legal votes for Gore in Palm Beach County and the 168 additional legal votes from Miami-Dade County.
Because time is of the essence, the circuit court shall commence the tabulation of the Miami-Dade ballots immediately. The circuit court is authorized, in accordance with the provisions of section 102.168(8), to be assisted by the Leon County Supervisor of Elections or its sworn designees. Moreover, since time is also of the essence in any statewide relief that the circuit court must consider, any further statewide relief should also be ordered forthwith and simultaneously with the manual tabulation of the Miami-Dade undervotes.
In tabulating the ballots and in making a determination of what is a "legal" vote, the standards to be employed is that established by the Legislature in our Election Code which is that the vote shall be counted as a "legal" vote if there is "clear indication of the intent of the voter." Section 101.5614(5), Florida Statutes (2000). NO REHEARING ALLOWED.

Please substitute corrected opinion. Corrections include the following (page numbers refer to the opinion as released December 8, 2000):
1. Pages 22-23. In the last sentence on page 22 of the majority opinion, the words "Where, as here," have been deleted, and the word "a" immediately following has been changed to a capital. Later in the same sentence, the clause beginning with the word "applying" and ending with the word "extrapolation" has been deleted, along with the commas before and after the clause.
2. Page 60. In the second sentence of the last paragraph of the dissenting opinion of Chief Justice Wells, beginning with the words "I agree with," the words "a quote from" have been changed to read "the view attributed to" and later in the same sentence the words "when he wrote that" have been changed to read "who was quoted as saying." In the first word of the immediately following quotation, brackets have been removed and the letter "t" has been changed to a capital.
3. Page 60. In the citation of authority appearing in footnote 32, the name of the author of the cited article has been added as well as a parenthetical providing the original source of the quoted words.
4. Page 68. In the second sentence of the second-to-last paragraph of the dissenting opinion by Justice Harding, the word "option" has been changed to read "direction" and the word "options" has been changed to read "directions."
5. Numerous other changes have been made throughout the opinions in order to correct grammatical, typographical, and citation form errors.

The Supreme Court ultimately mandated that any manual recount be concluded by December 12, 2000, as provided in 3 U.S.C. § 5. See id., slip op. at 12. In light of the time of the release of the Supreme Court opinion, these tasks and this deadline could not possibly be met. Moreover, upon reflection, we conclude that the development of a specific, uniform standard necessary to ensure equal application and to secure the fundamental right to vote throughout the State of Florida should be left to the body we believe best equipped to study and address it, the Legislature.
Accordingly, pursuant to the direction of the United States Supreme Court, we hold appellants can be afforded no relief.
