The parties are hereby directed to simultaneously file, no more than thirty (30) days from the date of this order, written responses addressing only whether respondent's motion for postconviction relief raising his affirmative misadvice claim was timely filed in accordance with the reasoning and case law set forth in Bates v. State, 29 Fla. L. Weekly S617 (Fla. Oct. 21, 2004). A ruling on respondent's "Petition for Extraordinary Habeas Corpus Relief and Motion for Consolidation to Pending Case Under Review," filed in this Court on March 24, 2003, and treated as a motion to consider ancillary issues, is hereby deferred until after receipt of the responses to this order.

The decision under review is quashed and this matter is remanded to the Fourth District for reconsideration upon application of this Court's decisions in Bates and Dickey.
