The Court requests supplemental briefing in this case limited solely to the following question: Because the defendant committed the offenses prior to July 1, 1984 (the effective date of the 1983 guidelines), but after October 1, 1983, does he have the right to select to be sentenced pursuant to section 921.001(4)(b)(1), Florida Statutes? Petitioner's supplemental brief on the merits, which shall not exceed twenty (20) pages in length, shall be filed on or before February 24, 2005; respondent's supplemental brief on the merits, which shall not exceed twenty (20) pages in length shall be filed on or before March 16, 2005; and petitioner's supplemental reply brief on the merits, which shall not exceed ten (10) pages in length, shall be filed on or before April 5, 2005. Please file an original and seven (7) copies of all briefs. Per this Court's Administrative Order In Re: Mandatory Submission of Electronic Copies of Documents AOSC04-84 dated September 13, 2004, counsel are directed to include a copy of all briefs in an electronic format as required by the provisions of that order. For the reasons expressed above, we hold that section 921.001(4)(b)(1) applies to Logan's offenses, and his affirmative election at resentencing was an election to be resentenced under the 1983 guidelines. We quash the decision of the Second District Court of Appeal and remand to the district court for proceedings consistent with this opinion.
