11/24/2004 ORDER-SHOW CAUSE (TAG-APPEAL-CONTROLLED BY LEAD CASE) Petitioner is hereby directed to show cause on or before December 9, 2004, why this Court should not summarily affirm the result reached by the Fifth District Court of Appeal in light of our decisions in Franklin v. State, 29 Fla. L. Weekly S538 (Fla. Sept. 30, 2004), and State v. Green, 29 Fla. L. Weekly S549a (Fla. Sept. 30, 2004). Respondent may file a reply on or before December 20, 2004.
12/13/2004 RESPONSE PT Howard H. Lewis BY: PT A. S. Rogers 964379 TO OTSC DATED 11/24/04
12/15/2004 NOTICE RS State Of Florida state1 BY: RS Mary Griffo Jolley 80454 OF INTENT NOT TO FILE A REPLY
04/21/2005 DISP-DISAPPROVED We expressly disapprove of the Fifth District's conclusion that a single subject violation occurred. See Franklin v. State, 887 So. 2d 1063, 1067 (Fla. 2004) (holding that chapter 99-188 did not violate the single subject rule). Our conclusion that no single subject violation occurred renders it unnecessary for us to address whether the retroactive application of the 2002 legislation to crimes occurring before that legislation took effect would be a violation of the ex post facto clauses of the Florida and United States Constitutions. See State v. Green, 887 So. 2d 1089, 1090 (Fla. 2004). Because the Fifth District also determined that these sentences were valid, albeit on different grounds, these cases need not be remanded for further proceedings.
