07/20/2004 ORDER-BRIEF SCHED (AG ADVISORY OPIN) On July 15, 2004, the Financial Impact Estimating Conference, in accordance with the provisions of Chapter 04-33, Laws of Florida, forwarded to the Office of the Attorney General a financial impact statement on the initiative petition. Chapter 04-33 provides for this Honorable Court to review the fiscal impact statement to determine whether it is in accordance with 100.371, Florida Statutes. The full text of the Attorney General's letter is attached hereto as an exhibit and made a part thereof. Interested parties shall simultaneously file both the initial and answer briefs on or before 12:00 noon, Tuesday, July 27, 2004, and serve a copy thereof on the Attorney General. Briefs are limited to ten (10) pages and the parties shall address the duties and responsibilities of the Court in this process and review and the application of these duties to this specific case.

08/03/2004 DISP-REMANDED (FIS-ADV OPIN) The Court finds that the first and third sentences in the financial impact statement do not comply with section 100.371(6), Florida Statutes, as amended by chapter 2004-33, section 3, Laws of Florida. Due to the use of the word "could" in the first sentence, the financial impact of the amendment is not expressed in terms of the "probable financial impact." Further, because the financial impact is expressed in terms of average cost savings "per Florida household" in the third sentence, the financial impact statement goes beyond addressing "revenues or costs to state or local governments." The Court remands the statement to the Financial Impact Estimating Conference ("Conference") for redrafting pursuant to section 100.371(6)(d)(1). In submitting any redraft, we direct the attention of both the Conference and the Attorney General to the time constraints in amended section 100.371(6)(b)(4).
