09/13/2004 ORDER-NO REQ&BRIEF SCHED/JURIS ACCEPTED (CERT JUDGMT) The Appellees have requested and the Appellants agree that this Court enter an order accepting the certification by the First District Court of Appeal of the non-final order of the trial court as involving a question of great public importance that requires immediate resolution by this Court. The Appellants have also requested the Court to accept the certification without staying the continued litigation in the trial court of the final hearing, which is scheduled for Wednesday, September 15, 2004. We have jurisdiction. See art. V, § 3(b)(5), Fla. Const. We conclude that the case involves matters of great public importance which require immediate resolution by this Court. Accordingly, we exercise our discretion to accept this case for review, but defer ruling on the non-final order until the trial court issues its final order, which the parties represent will be entered no later than Wednesday, September 15, 2004. Notwithstanding the provisions of Florida Rule of Appellate Procedure 9.130(f), the trial court shall proceed with the final hearing and entry of the final order. The appellees' motions regarding the automatic stay pursuant to Florida Rule of Appellate Procedure 9.310(b)(2) shall be determined by the trial court with any review by motion in this Court pursuant to Rule 9.310(f). Based on the parties' representation that the trial court will enter its final order on Wednesday, September 15, 2004, the parties shall file simultaneous briefing by noon on Thursday, September, 16, 2004, with this Court. Pursuant to Florida Rule of Appellate Procedure 9.130(d), we direct the Clerk of the Circuit Court for the Second Judicial Circuit to transmit the record of the proceedings below, including the full transcript of any hearing and the evidentiary exhibits presented, by noon on Thursday, September 16, 2004.

09/15/2004 ORDER-STAY PROCEEDINGS BELOW GR The Secretary of State has filed a motion to reinstate the automatic stay in light of the trial court's order granting plaintiffs' emergency motion to modify preliminary injunction and a Notice of Appeal of the Order Granting Plaintiffs' Emergency Motion to Modify Preliminary Injunction. In order to preserve the rights of the parties and the voters in anticipation of the impending disposition of the matter, this Court pursuant to the authority set forth in Florida Rule of Appellate Procedure 9.310(b)(2) grants the motion to reinstate the automatic stay in part only in that the provisions of the trial court's order in paragraphs (a) and (b) specifying actions to be taken on September 15, 2004, is stayed. This order is directed both to the Secretary's motion to reinstate the stay and to any subsequent automatic stay that would follow from any Notice of Appeal. However, the following condition is attached to the reinstatement of the automatic stay pursuant to Rule 9.310(b)(2): the Secretary of State shall instruct the Supervisors of Elections to desist from mailing ballots to voters pending further order of this Court. If this Court should determine that Nader and Camecho should not appear on the presidential ballot in Florida then the Court shall consider the remedies set forth in paragraphs (a) and (b) of the trial court's order regarding those ballots that have been already mailed prior to the entry of this order. This Court has scheduled oral argument in this cause for September 17, 2004, at 8:00 a.m., and is cognizant of the September 18, 2004, deadline for mailing overseas ballots.
