The Court accepts jurisdiction of this case. Oral argument will be set by separate order. Counsel for the parties will be notified of the oral argument date approximately sixty (60) days prior to oral argument. Petitioner's brief on the merits shall be served on or before April 11, 2005; respondent's brief on the merits shall be served twenty (20) days after service of petitioner's brief on the merits; and petitioner's reply brief on the merits shall be served twenty (20) days after service of respondent's brief on the merits. The Clerk of the Fourth District Court of Appeal shall file the original record on or before May 16, 2005.

On March 15, 2005, this Court entered its order accepting jurisdiction and advising that oral argument would be set by separate order. We have now determined that the Court is without jurisdiction and, therefore, the Petition for Review is dismissed as improvidently granted. No Motion for Rehearing will be entertained by the Court. See Fla. R. App. P. 9.330(d).
