Due to the large crowds now projected to be present on city right-of-way and on the capitol property at Waller Park, the pooling arrangement for post-argument interviews previously scheduled in the Special Procedures Order of May 25, 2005, is canceled. The site of the pool video and audio feed of oral arguments in this case will be moved to a location away from Waller Park to be determined by WFSU/The Florida Channel. Information about this pool feed can be obtained from Mike Dunn at WFSU at (850) 487-3170 ext. 348 or mdunn@fsu.edu. Broadcasters are reminded that a clean satelllite feed of the oral arguments is available by prior arrangement with Mr. Dunn under conditions he may require. Mr. Dunn should be contacted as early as possible to arrange for this service. Satellite information is as follows:

DISP-AFFIRMED
Because we conclude that section 1002.38 violates article IX, section 1(a) of the Florida Constitution, we disapprove the First District's decision in Holmes I. We affirm the First District's decision finding section 1002.38 unconstitutional in Holmes II, but neither approve nor disapprove the First District's determination that the OSP violates the "no aid" provision in article I, section 3 of the Florida Constitution, an issue we decline to reach. In order not to disrupt the education of students who are receiving vouchers for the current school year, our decision shall have prospective application to commence at the conclusion of the current school year.
