Because of significant public and media interest in this matter, counsel for the parties are directed to hereafter file an original and eight (8) copies of all pleadings filed with this Court. Per this Court's Administrative Order In Re: Mandatory Submission of Electronic Copies of Documents AOSC04-84 dated September 13, 2004, counsel are directed to include a copy of all documents, including any attachments and appendices, in an electronic format as required by the provisions of that order. A copy of AOSC04-84 is attached.

ORDER-BRIEF SCHED (AG ADVISORY OPIN)
Charles J. Crist, Jr., pursuant to the provisions of Article IV, section 10, Florida Constitution, and section 16.061, Florida Statutes, has requested this Court's opinion on the initiative petition seeking to amend the Florida Constitution to amend the Florida Constitution to protect people, especially youth, from addiction, disease, and other health hazards of using tobacco. On November 21, 2005, the Financial Impact Estimating Conference, in accordance with the provisions of Chapter 04-33, Laws of Florida, forwarded to the Office of the Attorney General a financial impact statement on the initiative petition. Chapter 04-33 provides for this Honorable Court to review the financial impact statement to determine whether it is in accordance with 100.371, Florida Statutes. The full text of the Attorney General's letter is attached hereto as an exhibit and made a part thereof. IT IS, THEREFORE, the order of the Court that interested parties shall file their briefs on or before December 19, 2005, and serve a copy thereof on the Attorney General. Answer briefs shall be filed on or before January 9, 2006. Briefs are limited to ten (10) pages and the parties shall address the duties and responsibilities of the Court in this process and review and the application of these duties to this specific case. Please file an original and eight (8) copies of all briefs.

For the reasons stated, we hold that the initiative petition and proposed title and summary meet the legal requirements of article XI, section 3 of the Florida Constitution, and section 101.161(1), Florida Statutes (2005), and that the financial impact statement is in accordance with section 100.371(6), Florida Statutes (2005). Accordingly, we approve the amendment and financial impact statement for placement on the ballot. We note, however, that no other issue is addressed herein and this opinion should not be construed as expressing either favor for or opposition to the proposed amendment. No motion for rehearing will be permitted.
