07/12/2007 DISP-DISAPPROVED Therefore, we approve the Fourth District's decision in Holy Cross and the Second District's decision in Jewell and disapprove the Fifth District's decision in CFP to the extent that it conflicts with this opinion. Because the trial court and Fourth District expressly declined to address any issues relating to the contracts between Beech Street and both Holy Cross and Allstate, any outstanding issues concerning the contracts should be addressed on remand.
