01/10/2006 NOTICE-INQUIRY RS Steve Paul BY: RS Ellen Anne Griffin 511889 FILED BY STEPHEN PAUL (01/11/2006: ADVISED CASE HEARD IN OA 01/09/2006 & IS STILL PENDING)
06/22/2006 DISP-QUASHED & REMANDED In conclusion, we approve in part the decision of the district court, to the extent that it found two criminal episodes occurred and that Paul could not be convicted of both a violation of section 800.04(6)(a)(1), Florida Statutes, and section 800.04(5)(a), Florida Statutes, for the acts which occurred in the living room. However, we quash the district court's determination that application of section 775.021 prohibits convictions of both section 800.04(6)(a) (lewd and lascivious conduct) and section 800.04(7) (lewd and lascivious exhibition) for the acts that occurred in the bedroom. We further disapprove the decision in Hunsicker to the extent that it is inconsistent with this opinion. The case is hereby remanded for further proceedings consistent with this opinion.
