The briefing schedule as to the questions certified by the First District Court of Appeal to be of great public importance is as follows: petitioner's initial brief on the merits shall be served on or before April 23, 2007; respondent's answer brief on the merits shall be served twenty days after service of petitioner's initial brief on the merits; and petitioner's reply brief on the merits shall be served twenty days after service of respondent's answer brief on the merits.

Upon further review of the First District Court of Appeal's underlying decision in this case, the Court has developed concerns about the split of votes on the certified questions of great public importance set forth therein. Specifically, three judges concurred in the judgment and certification; three judges dissented to the judgment but concurred in the certification; five judges concurred in the judgment but dissented to the certification; and one judge concurred in the judgment only. This appears to have resulted in a six-six split of votes as to certification. Given this split of votes, the Court questions whether it has jurisdiction over the certified questions of great public importance set forth in the decision below. Thus, in addition to the merits of the issues briefed, the parties are directed to be prepared to discuss this jurisdictional issue at oral argument. To that end, parties who submitted merits briefs in this case shall each submit a memorandum, not exceeding five pages in length, by noon on Tuesday, September 11, 2007, addressing this jurisdictional issue. Please file an original and seven copies of all memoranda.
