The First District Court of Appeal has certified, pursuant to article V, section 3(b)(5) of the Constitution of Florida, that the trial court passes upon a question of great public importance requiring immediate resolution by this Court. We accept jurisdiction.
Briefs shall be filed as follows: Appellant/Cross-Appellee's initial brief on the merits shall be filed on or before 5:00 p.m., October 30, 2007; Appellee/Cross-Appellants' answer/cross-initial brief on the merits shall be filed on or before 5:00 p.m., November 6, 2007; Appellant/Cross-Appellee's reply/cross-answer brief shall be filed on or before 3:00 p.m., November 9, 2007; and Appellee/Cross-Appellants' cross reply brief shall be filed on or before 3:00 p.m., Wednesday, November 14, 2007. Please file an original and eight copies of all briefs. UNLESS BRIEFS ARE TIMELY FILED, THE PRIVILEGE OF ORAL ARGUMENT WILL BE FORFEITED.
The Clerk of the Second Judicial Circuit in and for Leon County, Florida shall file the original record which shall be properly indexed and paginated on or before 5:00 p.m., October 26, 2007. The record shall include the briefs filed in the district court separately indexed.
IT IS FURTHER ORDERED that the above case has been set for oral argument at 9:00 a.m., Monday, December 3, 2007, with a maximum of twenty minutes to the side allowed for the argument.

Appellant/Cross-Appellee having filed a proper notice of dismissal pursuant to Florida Rule of Appellate Procedure 9.350(b), it is ordered that the appeal is dismissed. As a result of the voluntary dismissal, the automatic stay of the trial court's order, pursuant to Florida Rule of Appellate Procedure 9.310, is vacated. The trial court's order is final as to appellant/cross-appellee and can be enforced. Because the issues raised in Appellees/Cross-Appellants' Cross-Notice of Appeal do not require immediate resolution by this Court, the cross-appeal is hereby remanded to the First District Court of Appeal for resolution by that Court. Any pending motions, including motions to appear as amicus curiae for the Cross-Appellants, are denied without prejudice to refile in that Court. The above case which was scheduled for oral argument on December 3, 2007, has been removed from the oral argument calendar.
