Click to open document 01/29/2009 DISP-REMANDED For these reasons, we hold that the financial impact statements prepared by the Conference are fatally misleading and do not comply with section 100.371(5), Florida Statutes (2008). Thus, in accordance with our constitutional duty to ensure that Florida voters receive a fair and accurate ballot, see Askew, 421 So. 2d at 155, we are compelled to reject the statements as drafted. We remand the statements to the Financial Impact Estimating Conference for redrafting. See § 100.371(5)(e)(1), Fla. Stat. (2008).

02/25/2009 ORDER-BRIEF SCHED (AG ADVISORY OPIN) Pursuant to the provisions of Article IV, section 10, Florida Constitution, and section 16.061, Florida Statutes, the Attorney General of Florida has requested this Court's opinion on the initiative petition seeking to amend the Florida Constitution to establish standards for the Legislature to follow in legislative redistricting. On February 13, 2009, the Financial Impact Estimating Conference, in accordance with the provisions of Chapter 04-33, Laws of Florida, forwarded to the Office of the Attorney General a redraft of the a financial impact statement on the initiative petition. Chapter 04-33 provides for this Honorable Court to review the redrafted financial impact statement to determine whether it is in accordance with 100.371, Florida Statutes. The full text of the Attorney General's letter is attached hereto as an exhibit and made a part thereof. IT IS, THEREFORE, the order of the Court that interested parties shall file their briefs on or before March 17, 2009, and serve a copy thereof on the Attorney General. Answer briefs shall be filed on or before April 6, 2009. Briefs are limited to ten pages and the parties shall address the duties and responsibilities of the Court in this process and review and the application of these duties to this specific case. Please file an original and eight copies of all briefs.
