04/01/2010 ORDER-OTHER SUBSTANTIVE After carefully reviewing the numerous rule and form amendments proposed in this case and considering the comments filed, the Court seeks clarification and input from The Florida Bar rules committees and the Florida Court Technology Commission Subcommittee on Access to Court Records on several issues of concern to the Court. Those who filed comments in this case also are invited to provide input on the identified issues. The Court's main concern is how the amended rules will work in conjunction with each other and whether, if amended as proposed, the rules will conflict with each other or existing rules. For ease of reference, a compilation of the pending amendments, with the Court's proposed revisions, can be found on the Court's website at http://www.floridasupremecourt.org/decisions/proposed.shtml. The committees and subcommittee should coordinate their efforts and responses. The responses and any comments should be limited to the issues raised or revisions made by the Court. It is not the intent of the Court to revisit issues raised in prior submissions or to entertain additional comments on matters not identified by the Court. An original and nine copies of all responses and comments must be filed on or before May 12, 2010.

05/19/2010 ORDER-ORAL ARGUMENT RESCHEDULE By order dated April 1, 2010, the Court sought clarification and input from The Florida Bar rules committees and the Florida Court Technology Commission Subcommittee on Access to Court Records (Access Subcommittee) on a number of issues of concern to the Court, one of which is whether the various proposals requiring the truncation or redaction of certain personal information in documents filed with the court should be consistent. In response to that concern, the Access Subcommittee now recommends the creation of a new rule of judicial administration that would govern the filing of personal information in all types of cases and the inclusion of references to the new rule of judicial administration in the various other bodies of rules. Because the submission of the new proposed rule affects many of the areas of concern listed in the April 1, 2010, order and because there has been no coordination, as requested, with the rules committees or opportunity for the rules committees to respond, the Court determines that it is necessary to reschedule oral argument in this case and therefore enters the following order. At the direction of the Court, in order to give the affected rules committees an adequate opportunity to consider and comment on the Access Subcommittee's new proposal, oral argument has been rescheduled from June 7, 2010 to 9:00 a.m., Wednesday, October 6, 2010. Forty minutes is allocated for the argument, but the parties are expected to use only so much of that time as is necessary. If one has not already been filed, requests for oral argument must be filed on or before July 22, 2010. The Court requests that the parties appearing at oral argument address the issues on which further input has been sought by the Court pursuant to this and prior court order. If the allocation of time agreed upon is different than the notice of allocation of time filed on May 12, 2010, the parties shall notify the Clerk of Court no later than July 22, 2010, how the time is to be divided. All the affected Florida Bar rules committees are requested to file comments on the Access Subcommittee's proposal prior to oral argument. The Court specifically seeks input from the Rules of Judicial Administration Committee and directs that committee to consider the Access Committee's proposed new rule of judicial administration, as well as the other rules committees' proposals concerning the filing of personal information. The other rules committees should include in their comments proposed amendments to their bodies of rules necessary to implement the Access Subcommittee's new recommendation, should the Court decide to follow it. The rules committees should coordinate their comments. The Court would greatly appreciate a joint comment from the committees and coordination with the Access Subcommittee. Those who filed comments in this case also are invited to comment on the new proposal. All new comments should be limited to the Access Subcommittee's new recommendation. It is not the intent of the Court to revisit other issues or to entertain additional comments on other matters on which input previously was sought, unless the new proposal affects those prior comments. An original and nine copies of all comments must be filed with the Court on or before July 1, 2010. The subcommittee chair's response to the comments must be filed on or before July 22, 2010. Following the receipt of the additional comments and response, the Court will enter a revised order, if necessary, regarding areas that the Court requests be addressed at oral argument.

09/01/2010 ORDER-OTHER SUBSTANTIVE On May 12, 2010 the Criminal Procedure Rules Committee (Rules Committee) filed a comment requesting that the Court consider amending Rule of Judicial Administration 2.420(d)(1)(B) to include automatic sealing of certain categories of reports and evaluations in criminal case. This request is beyond the scope of the rule amendments under consideration in this case. Nevertheless, if this classification of records should be automatically sealed, the Court would want to address that matter as soon as possible through separate rule amendments. Accordingly, the Subcommittee on Access to Court Records (Access Subcommittee) is hereby directed to file a separate response to the comment filed by the Rules Committee. The Access Subcommittee's response should address whether psychological and psychiatric evaluations of criminal defendants are appropriate for inclusion as information that must be maintained as confidential under Rule of Judicial Administration 2.420(d)(1)(B). The response also should address the Rules Committee's alternative proposals that the Court 1) allow the circuit courts to continue the practice of authorizing and requiring the clerks of court to seal such records by way of administrative orders or 2) modify the proposed amendments to rules 3.211(c), 3.212(d), 3.218(a), and 3.219(a) to add the language "The court shall consider whether the report should be sealed as provided by Florida Rules of Judicial Administration 2.420." If the Access Subcommittee agrees that further amendments to Rule 2.420 are appropriate and proposes amendments, those amendments will be considered separately from the amendments pending in this case. If the Access Subcommittee does not agree that further amendments are appropriate, the Access Subcommittee should expressly explain its reasoning to the Court. An original and nine copies of the response should be filed on or before November 1, 2010.

We also amend the Family Law Rules of Procedure Forms and the Florida Supreme Court Approved Family Law Forms, as set forth in the appendix to this opinion, fully engrossed for use on the effective date of the amendments. By adopting the amended forms, we express no opinion as to their correctness or applicability.
