Luck of Carlton Fields 4000 International Place 100 S.E. Second Street Miami, Florida 33131-2114 are hereby appointed as counsel for Respondent. All further pleadings for Respondent shall be filed by the Respondent's counsel only. Pursuant to Florida Rule of Appellate Procedure 9.140(f)(4), the district court of appeal is hereby directed, within ten days from the date of this order, to provide to the above newly appointed counsel a copy of all filings before their court, including the record on appeal. The Court accepts jurisdiction of this case and will hear oral argument at 9:00 a.m., Wednesday, April 7, 2010. A maximum of twenty minutes to the side is allowed for the argument, but counsel is expected to use only so much of that time as is necessary. Petitioner's brief on the merits shall be filed on or before February 4, 2010; respondent's brief on the merits shall be filed on or before February 15, 2010; and petitioner's reply brief on the merits shall be filed on or before February 22, 2010. Please file an original and seven copies of all briefs. UNLESS BRIEFS ARE TIMELY FILED, THE PRIVILEGE OF ORAL ARGUMENT WILL BE FORFEITED. The Clerk of the Second District Court of Appeal shall file the original record which shall be properly indexed and paginated on or before February 15, 2010. The record shall include the briefs filed in the district court separately indexed. NO CONTINUANCES WILL BE GRANTED EXCEPT UPON A SHOWING OF EXTREME HARDSHIP.

Accordingly, we hereby discharge jurisdiction and dismiss this review proceeding. NO MOTION FOR REHEARING WILL BE ALLOWED.
