It is ordered that Henry G. Gyden of Haas, Lewis, DiFiore, P.A. 4921 Memorial Highway, Suite 200, Tampa, Florida 33634 is hereby appointed as counsel for respondent. All further pleadings for respondent shall be filed by the respondent's counsel only.

For the reasons discussed above, we conclude that the new constitutional rule announced in Blakely does not apply retroactively to sentences or resentences that were final when it issued. Accordingly, we quash the First District¿s decision in Johnson, and we approve the Fourth District¿s decision in Thomas. It is so ordered.
