03/22/2010 ORDER-JURIS ACCEPT/BRIEF SCHED (OA LATER DATE) The Court accepts jurisdiction of this case on the basis of conflict with Doyon v. Department of Highway Safety & Motor Vehicles, 902 So. 2d 842 (Fla. 4th DCA 2005), on the issue of double jeopardy. Oral argument will be set by separate order. Counsel for the parties will be notified of the oral argument date approximately sixty days prior to oral argument. Petitioner's initial brief on the merits shall be served on or before April 16, 2010; respondent's answer brief on the merits shall be served twenty days after service of petitioner's initial brief on the merits; and petitioner's reply brief on the merits shall be served twenty days after service of respondent's answer brief on the merits. Please file an original and seven copies of all briefs. The Clerk of the First District Court of Appeal shall file the original record which shall be properly indexed and paginated on or before May 24, 2010. The record shall include the briefs filed in the district court separately indexed.

11/04/2010 DISP-REV DISM IMPROVIDENTLY GRANTED (OA) We initially accepted jurisdiction to review the decision of the First District Court of Appeal in Bradsheer v. Florida Department of Highway Safety & Motor Vehicles, 20 So. 3d 915 (Fla. 1st DCA 2009), based on express and direct conflict with the decision of the Fourth District Court of Appeal in Doyon v. Department of Highway Safety & Motor Vehicles, 902 So. 2d 842 (Fla. 4th DCA 2005). After further consideration of the issues involved, we have determined that we should exercise our discretion to deny review. Accordingly, we hereby discharge jurisdiction and dismiss this review proceeding. NO MOTION FOR REHEARING WILL BE ALLOWED.
