The Court has now determined that oral argument is not necessary and the above case has been submitted to the Court without oral argument. M I Industries USA, Inc. shall have to and including January 4, 2010 in which to retain counsel to prepare the answer brief on the merits on its behalf. If counsel is retained, a Notice of Appearance needs to be filed with this Court within ten days of being retained. If counsel is not retained by M I Industries USA, Inc., the above case will be submitted to the Court for consideration without an answer brief on the merits on behalf of M I Industries USA, Inc..
