Petitioners' motion to stay filed in the above cause is granted and proceedings in the Third District Court of Appeal and in the Circuit Court of the Eleventh Judicial Circuit in and for Dade County, Florida, are hereby stayed pending this Court's determination of jurisdiction. Any proceeding to execute on the existing bond is hereby stayed and the existing bond posted pursuant to Florida Rule of Appellate Procedure 9.310 shall remain in effect pending further order of this Court. The Third District Court of Appeal is hereby directed to recall its mandate issued December 18, 2009.

The Court accepts jurisdiction of this case. Oral argument will be set by separate order. Counsel for the parties will be notified of the oral argument date approximately sixty days prior to oral argument.
