Having considered the motion for extension of time filed by Goldman, Naccarato Vela & Associates, it is ordered that jurisdiction of the above case is temporarily relinquished to the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida for a period of sixty days. The Honorable Bertila Ana Soto, Administrative Judge for the Criminal Division, is hereby appointed to preside over this matter. Judge Soto shall take such action as may be necessary to ensure that a complete record has been properly prepared and transmitted to this Court no later than sixty days from the date of this order. Judge Soto is directed to hold a status conference which shall be attended by the Clerk of Court, the appropriate court reporters, counsel and such other persons Judge Soto may deem necessary as soon as possible to determine what is necessary to complete the record. The time and place of the status conference shall be set by Judge Soto. The failure to timely file a record substantially affects this Court's ability to timely process its death cases and will not be tolerated. Counsel for the appellant is hereby directed to file a Status Report with this Court every thirty days as to the progress of the relinquishment proceeding.

This cause is before the Court on Appellant's "Amended Motion for Leave to File Amended Brief," filed on April 4, 2014, and Appellee's "Motion to Accept Oversized Brief," filed on April 7, 2014, seeking leave to file a brief of 118 pages.
The history of this case reveals that there have been numerous extensions of time deadlines and delays. However, the Court has determined that any possibly meritorious issues of which counsel is aware at this time should not be excluded from the initial brief.
Therefore, the Court orders as follows. Appellant's "Amended Motion for Leave to File Amended Brief" is hereby granted, and the amended initial brief shall be filed no later than 30 days from the date of this order. Appellee's "Motion to Accept Oversized Brief" is also hereby granted. Appellee shall have 15 days from the filing of Appellant's amended initial brief to file an amended answer/cross initial brief. Because Appellant will be raising additional issues, Appellee shall have leave to file an amended answer/cross initial brief not to exceed 125 pages. The reply/cross answer brief shall be filed 30 days after the filing of the amended/cross initial brief and the cross reply brief shall be filed 30 days after filing of the reply/cross answer brief.

Based upon the prosecutor's improper comments that permeated the State's closing argument, which repeatedly invoked "justice for Lazaro" and appealed to the passions of the jury, the "over zealousness in prosecuting the State's cause actually worked against justice, rather than for it." Gore, 719 So. 2d at 1203. Accordingly, we are compelled to vacate Cardona's convictions and death sentence and remand for a new trial.
It is so ordered.
