In accordance with the provision that the Supreme Court of Florida "shall permit adversary interests to present their views," art. III, §16(c), Fla. Const., the Court will accept written submissions expressing views regarding this question. The Court will also hear oral arguments by such number of persons as the Court shall deem appropriate to present the issue fully. An order setting the date and time of oral argument and who will be allowed to participate in oral argument will be issued at a later date. Submissions in this case must be filed with the Clerk of the Supreme Court of Florida no later than noon on the seventh day after the date the Attorney General petitions this Court for a declaratory judgment. The provisions of Florida Rule of Appellate Procedure 9.420(f) regarding computation of time for a period of time less than seven days are suspended. The Attorney General is authorized to file her views, if any, at a time separate from the filing of the petition for declaratory judgment, but no later than the time provided for other submissions. Submissions shall be in the form of briefs or comments and may include alternative plans. The Court will not accept alternative plans submitted separately from briefs or comments. Briefs must be in compliance with Florida Rule of Appellate Procedure 9.210 (except as otherwise suspended by this order). All submissions that satisfy the above requirements will be considered "official filings" and will be posted on the Supreme Court's website. All compliant submissions will also be posted on the Clerk's Office portion of the Court's website at http://www.floridasupremecourt.org/clerk/index.shtml. Submissions shall be filed only with the Clerk of the Supreme Court of Florida. Submissions or communications (e.g., comments, letters, resolutions by governmental entities, etc.) will not be considered by the Court or be filed in the official Court file unless such submissions or communications meet the filing requirements of this order. No e-mails will be accepted or considered by the Court. No submissions or communications shall be directed to any Justice. See Canon 3B(7), Code of Judicial Conduct ("A judge shall not initiate, permit, or consider ex parte communications, or consider other communications made to the judge outside the presence of the parties concerning a pending or impending proceeding...."). Further, only those who submit filings that comport with this order will be considered parties in this case. The Clerk's office will keep a daily revised service list, which will be posted on the Court's website. After the Legislature adopts a joint resolution of apportionment, those who intend to file an official filing with the Court shall, as soon as possible, file a notice of appearance with the Clerk to permit the Clerk to update the service list. Copies of all official filings must be served on all parties that appear on the service list on the date of the filing. The certificate of service must also separately include a certification that the service was made to all parties appearing on the most recently revised service list existing at that time. The Attorney General need not serve parties on the service list (if any) when the petition for declaratory judgment is filed with this Court.

In accordance with this Court's order dated February 13, 2012, the Court will hear oral argument in this case on Wednesday, February 29, 2012, commencing at 9:00 a.m. Oral argument will be limited to ninety minutes per side.
Those parties arguing in favor of the Legislature's Joint Resolution of Apportionment (proponents) shall argue first at oral argument. The proponents may reserve time for rebuttal out of the ninety minutes. The proponents' time shall be divided as follows between the proponents who requested oral argument. The proponents may decide among themselves the order of argument.
Those parties arguing against the Legislature's Joint Resolution of Apportionment (opponents) will argue after the proponents' initial argument.
The opponents' time shall be divided as follows among the opponents who requested oral argument. Opponents who requested oral argument are:

The opponents may decide among themselves the order of argument.
Two additional parties, Attorney General Pamela Jo Bondi and the Florida State Association of Supervisors of Elections, filed a comment or brief; but neither of them requested oral argument.
The parties shall file, no later than 12:00 noon Friday, February 24, 2012, a designation specifying the name of counsel who will argue for each party. If more than one attorney is going to argue for any party (and for this purpose the Coalition is one party) that party shall specify how the allocation of time will be divided.
The filing requirements as set forth in this Court's orders dated January 4, 2012, and January 25, 2012, remain in full force and effect.

Pursuant to that order, the League of Women Voters of Florida, the National Council of La Raza, and Common Cause Florida (together, the "Coalition") have filed a motion for leave to submit a reply brief. The Coalition's motion for leave to file a reply brief is granted. The Coalition shall have until noon on February 22, 2012, to file a reply brief not to exceed 15 pages, and the Florida House of Representatives, Florida Senate, and Attorney General shall have until noon on February 23, 2012, to file any responses to the reply brief not to exceed 15 pages.

Briefs have been filed by the following parties that rely on legislators' residences in support of arguments in opposition to the joint resolution of apportionment: (1) the Florida Democratic Party, and (2) the League of Women Voters of Florida, the National Council of La Raza, and Common Cause Florida (together, the "Coalition"). These parties shall provide this Court by noon on Wednesday, February 22, 2012, each Florida legislator's name and residence upon which they rely in their arguments with respect to whether the apportionment plans favor or disfavor incumbents. The parties shall also provide a description of the source of this information. The Florida Democratic Party and the Coalition shall at the same time provide a copy to the Attorney General, Florida Senate, and Florida House of Representatives, who will then have until noon on Thursday, February 23, 2012, to advise this Court, the Florida Democratic Party, and the Coalition whether any of the addresses are inaccurate and, if so, to provide the correct address. Because of privacy concerns, the addresses provided by the Florida Democratic Party and the Coalition, as well as any document containing the address of a legislator's residence, will not be posted on this Court's website.

In accordance with article III, section 16(c), of the Florida Constitution, the Court enters this declaratory judgment declaring the apportionment plan of the House of Representatives as contained in Senate Joint Resolution 1176 to be constitutionally valid under the Florida Constitution and declaring the apportionment plan of the Senate as contained in Senate Joint Resolution 1176 to be constitutionally invalid under the Florida Constitution. As contemplated by the Florida Constitution, in accordance with article III, section 16(d), the Legislature now has the task to "adopt a joint resolution conforming to the judgment of the supreme court." Art. III, § 16(d), Fla. Const. No motion for rehearing shall be entertained. This case is final.
