Click to open document 10/20/2015 ORDER-OA&BRIEF SCHED (AG ADVISORY OPIN) The Attorney General, pursuant to the provisions of Article IV, section 10, Florida Constitution, and section 16.061, Florida Statutes, has requested this Court's opinion as to whether the text of the proposed amendment by the People United for Medical Marijuana complies with Article XI, section 3, Florida Constitution, and whether the proposed ballot title and substance comply with section 101.161, Florida Statutes. Section 16.061, Florida Statutes, requires the Attorney General, within thirty days after receipt of the proposed amendment or revision to the State Constitution by initiative petition, to petition this Honorable Court for an advisory opinion regarding compliance of the text of the proposed amendment with Article XI, section 3, Florida Constitution, and compliance of the proposed ballot title and substance with section 101.161, Florida Statutes. The full text of the Attorney General's letter is attached hereto as an exhibit and made a part thereof. IT IS, THEREFORE, the order of the Court that interested parties shall file their briefs on or before October 30, 2015, and serve a copy thereof on the Attorney General. Answer briefs shall be filed on or before November 9, 2015. If filed by an attorney in good standing with The Florida Bar, the response must be a brief electronically filed via the Florida Courts E-Filing Portal in accordance with In re: Electronic Filing in the Supreme Court of Florida via the Florida Courts E-Filing Portal, Fla. Admin. Order No. AOSC13-7 (Feb 18, 2013). If filed by a non-lawyer or a lawyer not licensed to practice in Florida, the response must be in the form of a signed original letter that is mailed or hand-delivered to this Court; no additional copies are required or will be accepted. Oral argument is scheduled for 9:00 a.m., Tuesday, December 8, 2015. A maximum of twenty minutes to the side is allowed for the argument. All parties who have filed a brief and have asked to be heard may, in the Court's discretion, be permitted to participate in oral argument. The Court has been advised that the Financial Impact Estimating Conference intends to file the financial impact statement no later than October 23, 2015. Upon filing, the case addressing the validity of the corresponding financial impact statement will be consolidated with this case for oral argument purposes. The Court will issue a separate order scheduling briefing in that case upon filing.

Click to open document 12/17/2015 DISP-APPROVED Based on the foregoing, we conclude that the initiative petition and ballot title and summary satisfy the legal requirements of article XI, section 3, of the Florida Constitution, and section 101.161(1), Florida Statutes. In addition, the Financial Impact Statement is in compliance with section 100.371(5), Florida Statutes. We therefore approve the proposed amendment and Financial Impact Statement for placement on the ballot. It is so ordered.
