Click to open document 11/08/2016 ORDER-RESPONSE/REPLY REQUESTED (SPEC ISSUE) The Florida Bar and the Florida Family Law Rules Committee have filed a petition requesting that the Court adopt new Rule Regulating the Florida Bar 4-1.19 (Collaborative Law Process in Family Law) and new Florida Family Law Rule 12.745 (Collaborative Law Process). The Steering Committee on Families and Children in the Court and the Supreme Court Committee on Alternative Dispute Resolution Rules and Policy are requested to file a comment addressing the proposals on or before November 29, 2016. The Bar and the Committee shall file a response to the comments on or before December 14, 2016. In the response, the Court requests that the Bar and the Committee: (1) address the status of the Minimum Standards for Certification of Collaborative Attorneys, Mental Health Professionals, and Financial Professionals, and the Standards for Introductory Collaborative Trainings, referenced in the comment from Attorney Robert J. Merlin; and (2) clarify the references to subdivision (b)(1), and subdivisions (b)(1) and (b)(2), in rule 12.745(f)(2) and (f)(3)(B), respectively.

Click to open document 02/15/2017 ORDER-RESPONSE/REPLY REQUESTED The Court, having heard oral argument, hereby requests that The Florida Bar and the Florida Bar's Family Law Rules Committee file an amended proposal for Rule Regulating the Florida Bar 4-1.19 (Collaborative Law Process in Family Law), or other amendments to the Rules of Professional Conduct as necessary, that includes provisions requiring collaborative lawyers to inform clients considering participation in the collaborative law process as to the fees or costs the client can reasonably expect to incur in the process, including the lawyer's fees and reasonable fees for mental health and financial professionals. Given that the Collaborative Law Process Act adopted by the Florida Legislature in chapter 2016-93, Laws of Florida, does not take effect until after this Court adopts proposed rules of procedure and professional responsibility, the amended proposal must be filed with the Court on or before May 16, 2017.
