ORDER-COUNS APPOINTMENT

It is ordered that Thomas A. Burns of Burns, P.A., 301 West Platt Street, Suite 137, Tampa, Florida 33606-2292, is hereby appointed counsel for petitioner. All further pleadings for petitioner shall be filed by the petitioner's counsel only.
Pursuant to Florida Rule of Appellate Procedure 9.140(f)(4), the district court of appeal is hereby directed, within twenty days from the date of this order, to provide the above newly appointed counsel a copy of all filings before their court, including the record on appeal.
Unless otherwise requested by above counsel, petitioner's pro se initial brief on the merits will be stricken upon receipt of counsel's brief. Counsel is allowed to and including July 21, 2016, to file an initial brief on the merits or to notify the Court that he adopts petitioner's pro se initial brief. Respondent's answer brief on the merits shall be served twenty days after service of petitioner's initial brief on the merits or counsel's notice of adoption; and petitioner's reply brief on the merits shall be served twenty days after service of respondent's brief on the merits.

FSC-OPINION: We initially accepted jurisdiction to review the decision of the First District Court of Appeal in Gresham v. State, 181 So. 3d 1207 (Fla. 1st DCA 2015), based on express and direct conflict. See art. V, § 3(b)(3), Fla. Const. Upon further consideration, we conclude that jurisdiction was improvidently granted. Accordingly, we exercise our discretion and discharge jurisdiction.
It is so ordered.
