It is ordered that Rocco Joseph Carbone, III, of Eakin & Sneed, 599 Atlantic Boulevard, Suite 6, Atlantic Beach, Florida 32233, is hereby appointed as counsel for petitioner. All further pleadings for petitioner shall be filed by the petitioner's counsel only.
Pursuant to Florida Rule of Appellate Procedure 9.140(f)(4), the district court of appeal is hereby directed, within twenty days from the date of this order, to provide to the above newly appointed counsel a copy of all filings before their court, including the record on appeal.
The Court accepts jurisdiction.
Petitioner's brief on the merits shall be served on or before August 3, 2016; respondent's brief on the merits shall be served twenty days after service of petitioner's brief on the merits; and petitioner's reply brief on the merits shall be served twenty days after service of respondent's brief on the merits.
The Clerk of the Fifth District Court of Appeal shall file the record which shall be properly indexed and paginated on or before September 12, 2016. The
Clerk may provide the record in the format as currently maintained at the district court, either paper or electronic.

|
|
FSC-OPINION: For the reasons expressed above, we hold that, in appeals from conditional no contest pleas, stipulations of dispositiveness are binding on the appellate court. Accordingly, we quash the Fifth District's decision in Churchill and remand for the district court to consider the merits of Churchill's appeal. We also approve the Third District's decision in Finney regarding the binding effect of stipulations of dispositiveness.
It is so ordered.
