Click to open document 09/19/2017 ORDER-OTHER SUBSTANTIVE The President and the President-Elect of The Florida Bar Board of Governors (Board) have filed an "Out-of-Cycle Report of The Florida Bar Board of Governors" proposing the adoption of new Florida Rule of Judicial Administration 2.570 (Parental Leave). The President and President-Elect are hereby directed to file a supplemental report explaining the Board's authority to file an "out-of-cycle report" proposing a new Rule of Judicial Administration that is not joined in by the Rules of Judicial Administration Committee (RJA Committee). See Fla. R. Jud. Admin. 2.140(e) (authorizing Bar rules committees to propose out-of-cycle rule amendments if "in the opinion of the committee, a proposal is of an emergency nature, and the board of governors concurs."); Fla. R. Jud. Admin. 2.140(g)(2) (requiring that amendments to the Rules of Judicial Administration, other than the listed rules the Court amends without referral to or proposal from the RJA Committee, must be referred to or proposed by the RJA Committee, as provided in rule 2.140); See also In re Amends. to the Rules Regulating the Fla. Bar and the Rules of Jud. Admin.-Multijurisdictional Practice of Law, 991 So. 2d 842, 843 (Fla. 2008) (recognizing that the Rules of Judicial Administration are the province of the RJA Committee and amending Rule of Judicial Administration only after the Bar and the RJA Committee filed a joint proposal). The supplemental report must be filed on or before October 9, 2017. The Rules of Judicial Administration Committee may file a response to both the original and supplemental reports on or before October 24, 2017. Alternatively, the President and President-Elect may withdraw the Boards' report and work with the RJA Committee in an attempt to reach agreement on the parental leave issue and proceed with any resulting rule proposal in accordance with Florida Rule of Judicial Administration 2.140.
