Pursuant to Rules Regulating the Florida Bar (Bar Rules) 1-12.1(f) and 3-7.15, fifty-nine members in good standing of The Florida Bar (the Bar) have filed a petition proposing amendments to the Bar Rules. The petitioners propose amending Bar Rules 3-5.1, 3-5.3, and 4-3.1 to make conclusive, for purposes of pursuing professional sanctions instigated under the Bar Rules, an appellate court's finding that an attorney pursued or defended a frivolous claim. The Court appreciates the interest of the members of the Bar in the proper administration and application of the Bar rules. However, the Court, having considered the proposed amendments, comments filed, and the Bar's response, and having had the benefit of oral argument, will not adopt the proposed amendments at this time and hereby dismisses the instant petition.
