The comment filed by Leza Tellam on September 24, 2018, does not comply with Florida Rule of Judicial Administration 2.520 and is hereby stricken. Pursuant to rule 2.520, all documents filed in the Florida courts must be legibly typewritten or printed, on only one side of letter sized (8 1/2 by 11 inch) paper, and contain a one-inch margin on all four sides of every page of the filing. This margin must be clear of any marks or text, and the pages must be consecutively numbered. See Fla. R. Jud. Admin. 2.520(b).
Additionally, the comment must be served on the Committee Chair, Scott Michael Dimond, 2665 S. Bayshore Drive, # PH-2B, Miami, Florida 33131-5448, sdimond@dkrpa.com, and on the Bar Staff Liaison to the Committee, Mikalla Andies Davis, 651 E. Jefferson Street, Tallahassee, Florida 32399-2300, mdavis@floridabar.org, and contain a certificate of service certifying service on these individuals. See Fla. R. App. P. 9.410.
The Court will not consider the stricken comment unless and until it is refiled in compliance with the above requirements within 10 days from the date of this order.

The report should specifically address whether the proposed rule is substantive or procedural in nature. The Chair is allowed to and including January 7, 2019, in which to file the supplemental report. If the Committee needs more time to address the issue, the Chair may file a motion for extension of time with this office.

The above case is hereby scheduled for oral argument at 9:00 a.m., Wednesday, April 3, 2019. Thirty minutes is allocated for oral argument. Parties are expected to use only as much time as is actually needed.
The proponent of any change and any party filing a comment with the Committee prior to the filing of the report or with this Court are invited to participate in oral argument, provided a proper request for oral argument is filed with this Court on or before February 20, 2019.
The allocation of time must be agreed upon by the parties and shared by any interested parties who have requested oral argument. The parties must notify the Clerk of Court no later than March 12, 2019, how the time is to be divided.

FSC-OPINION: The Court thanks the Bar's Rules Committee and Pro Bono Committee for their efforts. The Court also takes this opportunity to thank the Access Commission for its efforts in identifying possible funding sources for nonprofit legal aid organizations and commends the Commission for its continued work to address the civil legal needs of low-income and moderate income Floridians. However, after thoroughly considering the Committees' joint report, the Rules Committee's majority and minority positions on the proposed cy pres rule, and the comment filed, and having heard oral argument, the Court declines to adopt the proposed rule.
