Click to open document 09/13/2019 DISP-VACATE AND REMANDED Appellant challenges the summary denial of his initial Rule 3.851 postconviction motion, which raised a number of claims. In its response to Appellant's motion, the State conceded that an evidentiary hearing was needed on some of the claims. A case management conference ("Huff hearing") was scheduled for February 12, 2018. Inexplicably, the trial court canceled the Huff hearing required by Florida Rule of Criminal Procedure 3.851(f)(5)(A), and entered an order summarily denying postconviction relief on all claims. We vacate the trial court's order dated January 18, 2018, and remand for a Huff hearing and further proceedings. NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DETERMINED.
Click to open document 01/22/2020 ORDER-NOTICE OF DELAY Article I, section 16(b)(10)b. of the Florida Constitution provides that all state-level appeals and collateral attacks on any judgment must be complete within two years of the date of appeal in non-capital cases and five years from the date of appeal in capital cases unless a court enters an order with specific findings as to why the court was unable to comply and the circumstances causing the delay. Pursuant to the administrative procedures and definitions set forth in Supreme Court of Florida Administrative Order No. AOSC19-76, this case was not completed within the time frame required by Article I, section 16(b)(10)b. because the time frame had already expired by the time this case was filed.
