Click to open document 02/14/2020 DISP-DISM MISC (FLA BAR) Upon consideration of the Report of Referee and the briefs filed in this matter, and having had the benefit of oral argument, this case is hereby dismissed. See R. Regulating Fla. Bar 3-7.16(a) (2009). Rule 3-7.16(a) provides that "complaints presented . . . to The Florida Bar under these rules shall be commenced within 6 years from the time the matter giving rise to the inquiry or complaint is discovered or, with due diligence, should have been discovered." This proceeding was initiated by a December 9, 2016, complaint alleging misconduct on May 5, 2009, more than 6 years earlier. Although it appears that the complainants could have reported the violation as continuing beyond May 5, 2009, they did not do so. The Bar's formal complaint also only addressed the May 5, 2009, violation and did not advance a continuing violation theory. Although references were made in the briefs, and at oral argument, indicating that the Bar at one time pursued a similar disciplinary proceeding against Respondent based upon its independent investigation, which may have been timely under a different provision of Rule 3-7.16(a), it is clear that the formal complaint in this case is governed by the limitations period quoted above.
