Per this Court's Administrative Order In Re: Mandatory Submission of Electronic Copies of Documents AOSC04-84 dated September 13, 2004, counsel are directed to include a copy of all documents, including any attachments and appendices, in an electronic format as required by the provisions of that order. 06/28/2006 ORDER-BRIEF SCHED (GOV-ADVISORY OPIN) Pursuant to article IV, section 1(c), Florida Constitution, on June 20, 2006, the Governor of Florida has requested this Court's opinion on a question of constitutional interpretation affecting his executive powers and duties. The Court has determined that the request is within the purview of the above-noted constitutional provision and the Court will exercise its discretion to provide an opinion in response to the Governor's request. Interested parties shall file their comments or briefs on or before July 18, 2006, and serve a copy on the Governor. Please file an original and eight (8) copies of all comments. In addition to paper comments, per this Court's Administrative Order In Re: Mandatory Submission of Electronic Copies of Documents AOSC04-84 dated September 13, 2004, counsel are directed to include a copy of all comments in an electronic format as required by the provisions of that order. Comments will be placed on the Court's Internet site (http://www.floridasupremecourts.org).

Click to open document 09/15/2006 DISP-ADVISORY ANSWERED (GOVERNOR) Accordingly, we answer your question regarding the mandatory retirement of Judge Ervin by stating it is our opinion that the clear and unambiguous language of article V, section 10(a) of the Florida Constitution dictates that Judge Ervin's position will become vacant when his term expires.
