ORDER-REFEREE FOR ADD'L PROCEEDINGS
|
|
Upon consideration of the Report of Referee and briefs filed in this case, it is the judgment of this Court that the Report of Referee filed with this Court on July 20, 2018, is hereby disapproved. Specifically, the Report of the Referee does not include findings of fact as to each item of misconduct of which the respondent is charged. See R. Reg. Fla. Bar 3-7.6(m)(1). The Court hereby refers this case back to the referee for additional proceedings in accordance with the Rules Regulating the Florida Bar. The referee shall file an amended report containing findings of fact for each item of alleged misconduct and applicable recommendations, as required by Rule Regulating the Florida Bar 3-7.6(m)(1). Because the referee has recommended that the respondent be found guilty of several charged violations, diversion is not authorized under Rule Regulating the Florida Bar 3-5.3(h)(2). Accordingly, the referee must recommend a disciplinary measure recognized in Rule Regulating the Florida Bar 3-5.1. The referee shall file an amended report within 90 days from the date of this order.
