Pursuant to article IV, section 1(c), Florida Constitution, on January 6, 2009, the Governor of Florida has requested this Court's opinion on a question of constitutional interpretation affecting his executive powers and duties.
The Court has determined that the request is within the purview of the above-noted constitutional provision and the Court will exercise its discretion to provide an opinion in response to the Governor's request.
IT IS THEREFORE, the order of the court that interested parties shall file their briefs on or before January 19, 2009, and serve a copy on the Governor. Please file an original and eight copies of all briefs. In addition to paper briefs, per this Court's Administrative Order In Re: Mandatory Submission of Electronic Copies of Documents, AOSC04-84, dated September 13, 2004, counsel are directed to transmit a copy of all briefs in an electronic format as required by the provisions of that order. Briefs will be placed on the Court's Internet site (http://www.floridasupremecourt.org/clerk/briefs/index.shtml).
Oral argument is scheduled for 9:00 a.m., Tuesday, January 27, 2009. A maximum of twenty minutes to the side is allowed for the argument. All parties who have filed a brief and have asked to be heard may, in the Court's discretion, be permitted to participate in oral argument.
